We value your privacy and want to be transparent about how we handle your data.
We make every effort to ensure the security and confidentiality of your data. We care about your privacy, both when you visit our websites, register an account with us and use our services, as well as when you contact us by phone, email or online chat, subscribe to our newsletter or visit our social media channels. We act in compliance with the rule of law, including provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (hereinafter the "GDPR").
In this document (“Policy”), we would like to provide you with essential information about your personal data processing. All of this is to let you know why, on what basis and for how long we process your data, as well as who can access it and what rights you have.
This Policy applies to consumer users (individually referred to as “you”) of Volumeen’s websites, applications, and other online services (collectively, our “Sites”).
Other third parties, such as small and medium businesses (“SMBs”) at which you make reservations through our Sites and social networks that you use in connection with our Sites, may also collect, use, and share information about you. This Policy does not cover such third parties or their services. For information about third-party privacy practices, please consult with them directly.
1. Who we are and how we operate
The Volumeen platform is a technology product created and owned by Jakub Domaradzki ("Licensor"). It is operated, managed, and legally represented by JMDomaradzki & Co Sp. z o.o. with registered office in Cracow, Poland ("JMDomaradzki", "Licensee" or "Operator"), NIP (tax identification number): 6793199240, KRS: 0000839997, REGON: 386013584, including its agents and subsidiaries.
By using our Sites, you are entering into a relationship with JMDomaradzki, which is the entity responsible for protecting your data and handling all legal matters related to the service.
We aim to provide a seamless experience. Therefore, it may happen that a different company takes over the license to operate Volumeen in the future.
In the event that our license agreement with the Licensor expires, terminates, or is assigned to a third party, we reserve the right to transfer the operation of the platform to a new designated entity ("Successor Operator").
2. Data we collect
We collect data about you in various ways when you use our Sites. We use this data to, among other things, provide the functionality and improve the quality of our Sites and personalize your experience. For example, we may collect your name, date of birth, your photo, email address, postal address, your mobile phone number, billing information, survey responses, demographics, current and prior appointments details, favorite SMBs, special SMB requests, passwords, contact information of people you add to, or notify of, your appointments through our Sites, and other information you provide on our Sites. If you use our mobile application we may also collect your mobile device ID, your precise location data, and the SMB search locations you select. You can check or edit your personal data that you have provided to us at any time by going to the "Profile" > "Account" tab in the Volumeen web application.
When you visit our Sites, some data are automatically collected. For example, when you visit our Sites, we may automatically collect your location, computer operating system, Internet Protocol (IP) address, access times, browser type and language, and the website you visited before our Sites. We also collect information about your usage and activity on our Sites using certain technologies, such as cookies. We may automatically collect data using “cookies” and similar technology. Cookies are small data files that may have unique identifiers and reside, among other places, on your computer or mobile device, in emails we send to you, and on our web pages. Among other things, cookies help us improve our Sites and your experience. We use cookies to see which areas and features of our Sites are popular and to count visits to our Sites. We may access data contained in cookies placed on your device by a Third-Party Platform as permitted by the terms of service and privacy settings with such Third-Party Platform. We may share this data with the Third-Party Platform for its use as permitted by the terms of service and privacy settings with such Third-Party Platform.
Thanks to cookies, we collect anonymous data about users' visits to the Website, which we can use to improve the functionality of the Website, identify errors or for marketing purposes.
Usually, web browsers allow the use of the cookies on the end device by default. However, users can block and restrict the installation of cookies at their own discretion, using their browser settings or by using other (free) solutions. During your first visit to the Website, we will display you the information on the use of cookies. If you do not change the settings of your browser, you will agree to their use. Please be informed that disabling or restricting the use of cookies may cause difficulties in using the Website, e.g. it may take longer to load the Website or restrict the use of its functionality or Facebook page likes.
3. How we use data we collect
We use personal data collected through our Sites to:
- Make and change your appointments made through our Sites;
- Offer you, or provide you with, products and services through our Sites;
- Operate and improve our Sites, products, and services;
- Understand your preferences to enhance and customize your experience using our Sites, products, and services, such as understanding your appointment history to make recommendations about other SMBs you may like;
- Process and deliver contest entries and rewards;
- Display relevant advertising;
- Respond to your comments and questions and provide customer service;
- Send you information relating to our products and services, including reservation confirmations, receipts, technical notices, updates, security alerts, and support and administrative messages;
- Communicate with you about contests, offers, promotions, rewards, upcoming events, and other news about products and services offered by Volumeen and our partners;
- Link or combine with other personal data we get from third parties to help understand your needs and provide you with better service;
- Authenticate your credit or debit card account data;
- Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity. By providing your mobile phone number, you expressly consent to receive direct dial calls, autodialed and prerecorded message calls, and text messages from us relating to our product and services at that number.
Volumeen may store and process personal data in the United States and other countries.
We process your personal data:
- to conclude and perform the contract for the provision of services (registration and maintenance of the Customer account, placing orders for free of charge and chargeable services, execution of the contract) - until the end of performing the service (deletion of the Customer account, termination of the contract for the provision of services);
- to comply with tax obligations (issuing invoices, keeping accounting records) - until the expiry of the prescription periods for tax obligations;
- to comply with personal data protection legal requirements: - until the expiry of the prescription periods for claims due to the breach of data protection legislation;
- to determine, pursue and defend possible claims - until the expiry of the prescription periods for claims under applicable law;
- to ensure the proper functioning of the website and to analyse the activity of website users (e.g. Google Analytics, cookies) - until an effective objection is raised or the purpose of the processing is achieved;
- to run a fan page on Facebook, Instagram, X, LinkedIn or other social media services to interact with the users - until the expiry of the prescription periods for claims under the applicable legislation;
- to answer your questions addressed to us by telephone or email, including via the form available on the website and online chat - until the expiry of the prescription periods for claims under applicable law;
- for marketing purposes (promotion of our goods and services) - until an effective objection is raised or the purpose of the processing is achieved, and in the case where the basis for the processing is the consent of the data subject until the consent is withdrawn (whereby withdrawal of the consent does not affect the lawfulness of data processing prior to its withdrawal);
- for research into preferences in terms of demand for services - until the termination or expiry of the contract or until you object to processing for that purpose;
- for the purpose of implementing or developing new solutions/features of Volumeen systems/applications - until the termination or expiration of the contract or until you object to data processing for this purposep.
We process your personal data, as long as it is necessary to achieve the aforementioned purposes unless you make a valid and proper request for your personal data to be deleted. In addition, the period of the processing may be subject to the content of the legal provisions applicable to us, e.g. in the case of the storage of financial documents or the time limits for pursuing the claims.
4. How do we share collected data
In certain situations, if this proves necessary for the purposes of data processing, we rely on the support and assistance of external entities. However, each time, prior to the transfer of personal data, we require the recipients to guarantee an adequate level of data protection and confidentiality.
The recipients of your personal data may be:
- entities involved in the performance of our contracts, e.g., accounting office, IT services providers, hosting services providers, payment systems providers,
- entities whose help and services we use in the scope of our business activity on the basis of separate agreements, e.g. providers of tools to analyse activity on the website and direct marketing, suppliers of tools for creating landing pages and collecting leads, suppliers of the office systems, suppliers of project management software, suppliers of communication software,
- authorised state authorities under applicable laws,
- other entities whose request for data transfer is justified under the applicable laws,
- SMBs - when you make an appointment through our Sites, your data are provided to us and to the SMB with whom you choose to make the appointment. In order to facilitate your appointment, your data are provided to that SMB, just as it would if you made an appointment by calling the SMB, emailing the SMB, or using the SMB’s website. If you provide a mobile phone number, SMBs may send you text messages regarding your reservation. Some SMBs also require you to provide credit or debit card account data to secure your appointment. When you make an appointment through our Sites we may also share with the SMBs additional data, such as information about your history or data that we collect via Third-Party Platforms You also have the option of indicating special preferences or providing comments about your appointment that Volumeen will pass on to that SMB.We may share with SMBs summary reports of feedback from clients. If you provide comments about a SMB through our Sites, these comments may be shared with that SMB. We will not tie your comments with other data that can identify you, but a SMB may be able to tell who you are from your comments, particularly if you give your name in the comments or provide contact information, such as an email address. Information you choose to share with a SMB when you make an appointment and/or pay a SMB through our Sites may be used by the SMB for its own purposes. Volumeen does not control the privacy practices of SMBs. Please contact the SMB directly if you want to learn about its privacy practices.
Our Sites may allow you to connect and share your actions, comments, content, and data publicly or with friends on Third-Party Platforms such as Facebook or Instagram. Our Sites may also allow you to connect with us on, share on, and use Third-Party Platforms, including those on which Volumeen has a presence. Please be mindful of your personal privacy needs and the privacy needs of others as you choose whom to connect with and what to share and make public. We cannot control the privacy or security of data you choose to make public or share with others. Volumeen also does not control the privacy practices of Third-Party Platforms. Please contact those sites and services directly if you want to learn about their privacy practices.
We may disclose your personal data to comply with laws and to respond to lawful requests and legal process or to protect the rights and property of Volumeen, our agents and customers, and others, including to enforce our agreements, policies, and terms of use, and (iii) in an emergency to protect the personal safety of Volumeen, its customers, or any person.
We may disclose or transfer your personal data to a third party if we sell, transfer, divest, or disclose all or a portion of our business or assets to another company in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding.
We may also share aggregated or de-identified data with third parties in our discretion.
We do not share your SMS opt-in consent with any third-party organizations.
To ensure you do not lose access to your account, appointment history, or platform functionality, Operator is obligated to transfer your personal data to the Successor Operator as part of the transition of service. This transfer is conducted to fulfill our contractual commitment to provide you with a continuous service. In such an event:
- The Successor Operator will assume all rights and obligations regarding your data.
- You will be notified of any change in the identity of the Data Controller.
- Your data will continue to be protected under the standards set forth in this Policy unless you are otherwise notified.
5. How do we protect your personal data
Volumeen takes reasonable steps to help protect your personal data in an effort to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. When your data are being transmitted to our Sites or through our Sites, data will be protected by encryption technology, such as Secure Sockets Layer (SSL).
To be clear, Volumeen does not itself store your credit or debit card account data and we do not have direct control over or responsibility for your credit or debit card account data. Our contracts with third parties that receive your credit or debit card account data require them to keep it secure and confidential.
Nonetheless, we cannot guarantee that transmissions of your credit or debit card account data or personal data will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by Volumeen or our third-party service providers. We assume no liability or responsibility for disclosure of your data due to errors in transmission, unauthorized third-party access, or other causes beyond our control. You play an important role in keeping your personal data secure. You should not share your user name, password, or other security data for your Volumeen account with anyone. If we receive instructions using your user name and password, we will consider that you have authorized the instructions.
To ensure a high and consistent level of protection, we use IT environment safeguards adequate for the processing, as well as technical and organisational measures, which include, among others:
- TLS protocol encryption,
- creating backup copies,
- equipping data centres with data protection mechanisms,
- conducting regular security level tests,
- monitoring the security of personal data,
- mitigating the risk of potential abuses and reacting promptly in case of their occurrence,
- implementing data protection policies,
- ensuring continuous confidentiality, integrity, availability and resistance of the processing systems and services,
- allowing access to personal data only to authorised persons,
- creating and regularly modifying passwords to access systems where personal data are processed.
6. Whar rights do data subject have
Data subjects whose data we process have the rights to:
- access to their personal data;
- change their personal data;
- remove their personal data;
- restrict the processing of personal data;
- object to the processing of personal data;
- transfer the personal data;
- withdraw consent to the processing of personal data (provided that the processing is based on the consent of a data subject).
However, the rights listed above are not absolute, and in certain circumstances, after analysis, we may legitimately refuse to exercise them.
Please also be informed that the withdrawal of your consent to data processing will not affect the lawfulness of data processing that took place on the basis of the consent given before its withdrawal.
If you request us to exercise any of the above rights, we will respond to your request without delay, but no later than within one month of its receipt. If due to the complexity of the request or the number of requests, we are unable to comply with your request within one month, we will comply with it within a further two months. However, we will inform you of the intended extension of the deadline beforehand.

8. Sending logs to the server
The use of the Website involves sending queries to the server on which the Website is hosted. Each query sent to the server is recorded in server logs and stored on the server. The logs include, among others, the IP address, date and time of the server, information about the Internet browser and operating system.
The data stored in the server logs are not associated with specific users of the Website and are not used by us to identify you.
The server logs constitute solely auxiliary material used to administer the Website, and their content is not disclosed to anyone except persons authorised to administer the server.
9. Changes to This Policy
Personal data protection is a process that we adapt to meet current needs and changing technology. Therefore, our Privacy Policy may be supplemented or amended, as we will inform you by a post on the website, and in the event of material changes, we will send separate notices on the amendment to registered service users by email.
Volumeen may update or revise this Policy from time to time. You agree that you will review this Policy periodically. If we make any changes to this Policy, we will change the “Last Updated” date below. You are free to decide whether or not to accept a modified version of this Policy, but accepting this Policy, as modified, is required for you to continue using our Sites. If you do not agree to the terms of this Policy or any modified version of this Policy, your sole recourse is to terminate your use of our Sites.
